Airsoft games can be played at any place in New York that is officially registered for it. Thankfully, we have both our Long Island and Staten Island locations available for safe and legal play. Still, it is important to be aware of airsoft guns, and the regulations about them in New York.

Can you tell if this is an actual fire arm or airsoft gun?

Airsoft guns, or “BB guns” used to be notorious for being fun toys. Most of us remember running around shooting BBs at our siblings with the light guns that have the notorious orange tips.  Now in 2022, thanks to exponential technological advancements; airsoft guns look and feel more like actual firearms than ever before. Unfortunately, due to this similarity in appearance people have used airsoft guns to commit intentional crimes. Which is why New York State and New York City are very cautious about airsoft guns, and have regulations in place to limit their use, trading and selling. 

So what exactly are the regulations? Let’s start with the federal laws and work our way down to local, because this can be a little confusing. 

Federal Law

The federal law (https://uscode.house.gov/view.xhtml?req=(title:15%20section:5001%20edition:prelim) supersedes any state or local law and ordinance. In a nutshell, this law ensures that every airsoft gun must have a “blazing orange” permanently affixed barrel piece (unless otherwise noted in the conditions of the law- see link above!).

State Law

New York state laws take a more common sense approach. They focus on keeping airsoft guns out of the hands of minors, establishing the legal age to purchase a gun propelled by spring or air as 16 years old (https://www.nysenate.gov/legislation/laws/PEN/265.05).

Local Laws and Ordinances

Now to the local laws and ordinances. Cities are permitted to impose more strict regulations within their city limits. For example: New York City prohibits the sale of airsoft guns without an appropriate license except in limited circumstances. For this reason we are able to sell airsoft inventory at our Long Island location, but unfortunately not at our Staten Island location.
